Florida Agency Rules

Only Exclusive Buyers Broker are ALWAYS on the home buyers side…

Florida has diluted Florida agency rules by reducing agency disclosures and agent accountability, in order to make it easier for Real Estate agents to do business with both the buyer and seller in the same transaction…which of course is a conflict of interest.

 

So unless you keep reading, you may never know who may or may not be on your side in a real estate transaction.

 

Florida Agency rules say that Only Exclusive Buyers Agents can ALWAYS advocate for the home buyer.  Buyers Broker of Florida is an Exclusive Buyer Agency Office that specializes in Buyer Representation.

 

Florida’s Transaction Broker:

 

Florida Agency Rules say that unless you have an written agreement with a buyers agent for representation, you are not really being represented (99.9% of real estate licensees in Florida practice as “Transaction brokers”) Transaction Brokers offer NO fiduciary duties of loyalty, confidentiality, or full disclosure.  They claim to “represent” but the law says they cannot advocate…

 

They are only “middle-persons” facilitators who must remain “neutral” as they do not advise, or advocate for either buyer or seller. Under this Florida Agency Rule, neither the buyer or seller is truly represented. Working with a Transaction broker is NOT the best choice for a Florida Home Buyer.

 

Sellers Agent:

 

Under Florida Agency Rules, a sellers agent or listing agent works ONLY in the best interest of the seller. A Sellers agents  job is to sell the property for the highest price and best terms for the seller…even when they are showing you, the home buyer the home, their loyalty is to the seller only. A sellers agent works for the seller and against the home buyer.

 

Buyer’s Agent in a regular/traditional office:

 

These offices list homes for sale and primarily represent sellers.  They may occasionally represent a buyer, may also represent a seller and may switch to being a Transaction broker…all in the same day while they are showing you properties. Florida Agency Rules say that agents can switch roles several times a day sometimes in the same hour. They may or may not represent the homebuyer…why wonder?
